These Terms of Service ("Terms") govern your access to and use of services, programs, and content offered by BlackBird Productions. (“BlackBird,” “we,” “us,” or “our”) via our website and other delivery channels. By accessing or using our website or services (including purchasing or booking), you agree to be bound by these Terms. If you do not agree, do not access or use our services.These Terms apply to all users, including visitors, clients, participants, and purchasers. We reserve the right to modify these Terms at any time; updated Terms will be posted on this page, and your continued use constitutes acceptance of those changes.

By using our services, you represent that you are at least the age of majority in your jurisdiction or have obtained parental/guardian consent to participate. You may not use our services for any unlawful purpose or in violation of applicable laws. You must not transmit any viruses, malware, or other harmful code. Breach of these Terms may result in immediate termination of access to services.

BlackBird Productions provides trauma-informed coaching, educational programs, courses, and community services. Our services are coaching and educational in nature — they are not psychotherapy, medical care, legal advice, or financial advice. BlackBird Productions does not diagnose, treat, or cure mental health conditions and does not provide crisis intervention or emergency services.

Guarantees & Results: Results vary from person to person. BlackBird Productions makes no guarantees regarding specific outcomes. Testimonials and case studies reflect individual experiences and are not predictive of results for any individual.
No Therapist-Patient Relationship: Participation in BlackBird Productions services does not create a therapist-client, physician-patient, or similar professional relationship.

Program descriptions, pricing, schedules, and enrollment details are provided on our website or via program materials. Enrollment is complete once payment and registration are confirmed.

We may offer payment plans, promotional pricing, or limited-time offers; those will be described where applicable. We reserve the right to change program offerings, schedules, and fees.

Our refund, cancellation, and rescheduling policies are posted with each program and at checkout. General policies include:

A $25 same-day cancellation fee may apply for single sessions (where stated).
Program-specific deposits or non-refundable fees will be indicated at purchase.
For multi-session programs, missed sessions may be subject to the program’s make-up policy.

Clients agree to participate in sessions in good faith, follow any reasonable program requirements, and engage respectfully with facilitators and peers. BlackBird Productions reserves the right to refuse service, or to suspend or terminate participation for conduct that we reasonably determine is disruptive, abusive, or harmful.

All content, materials, curricula, workbooks, methods, trademarks, and intellectual property provided by BlackBird Productions are owned by BlackBird Productions or used under license. You may not copy, reproduce, distribute, share, sell, or create derivative works from these materials without express written permission. Unauthorized use may result in termination of access and legal action.

We may provide access to third-party tools (payment processors, scheduling software, video platforms, analytics, etc.). Those tools are provided “as is” and subject to third-party terms. We are not responsible for third-party services or content. Our site may contain links to external websites; we are not responsible for their content or practices.

Program enrollment may include digital materials (workbooks, checklists, worksheets, recordings). Lifetime access, post-program check-ins, or similar benefits (if offered) will be described at enrollment. BlackBird Productions retains the right to change included materials with notice.

To the fullest extent permitted by law, BlackBird Productions and its officers, employees, contractors, affiliates and partners will not be liable for any direct, indirect, incidental, consequential, special, or exemplary damages (including lost profits, loss of data, or other intangible losses) arising from your use of the services, materials, or site, even if advised of the possibility of such damages.

Where a jurisdiction does not allow limitation or exclusion of liability, our liability will be limited to the maximum extent permitted by law.

By scheduling or attending sessions or participating in programs, you acknowledge that BlackBird Productions coaching is educational and not medical, psychological, legal, or financial advice. You remain solely responsible for your decisions and outcomes.

You agree to indemnify, defend, and hold harmless BlackBird Productions, BlackBird Productions Healing & Recovery, Vaughn Nelson, and their officers, directors, employees, agents, contractors, licensors, and suppliers from and against any claims, liabilities, losses, damages, costs and expenses (including reasonable attorneys’ fees) arising out of or related to your participation in our services, except to the extent caused by our gross negligence or willful misconduct.

Assumption of Risk: You acknowledge that participation may include discussion of sensitive or triggering material. If you are in crisis or have active suicidal ideation, uncontrolled substance dependence, or are in immediate danger, please seek emergency or medical care; BlackBird Productions is not a crisis service.

BlackBird Productions may, at its discretion, recommend that clients seek evaluation or treatment from licensed mental health or medical professionals when clinically appropriate. Referrals are recommendations only; BlackBird Productions does not guarantee clinical results from referred providers.

If you submit comments, testimonials, or user-generated content, you grant BlackBird Productions a non-exclusive, royalty-free, worldwide license to use, reproduce, and display that content for promotional and informational purposes, unless a confidentiality or anonymity request has been agreed in writing. We will honor requests to anonymize identifying information where requested.

You agree not to use the service for unlawful purposes or to infringe others’ rights, or to post malicious content (viruses, malware). We may suspend or terminate access for prohibited conduct.

If any provision is held invalid, the remainder remains in force. Either party may terminate access in accordance with these Terms. These Terms (and any policies referenced herein) constitute the entire agreement between you and BlackBird Productions regarding use of our services.

These Terms are governed by and construed in accordance with the laws of the State of New Jersey, without regard to its conflict of law principles. Any disputes, claims, or legal proceedings arising out of or related to these Terms or your use of BlackBird Productions services shall be brought exclusively in the state or federal courts located in New Jersey, and you consent to personal jurisdiction in those courts.

We may update these Terms from time to time. We will post the revised Terms on our site; continued use indicates acceptance.
